Wi-fi Terms and Conditions

  

Introduction

Please read these terms and conditions (Terms) carefully; they govern your use of this wireless local access network service (“the Service”). In these Terms “us”, “we” or “our” means “the Public Transport Authority or PTA” and “you” or “your” means the individual using the Service.
By accessing the Service, you agree to these Terms. If you do not agree to the Terms, do not use the Service.

 

The Service

You acknowledge that the Service is not intended to be a high-performance internet service.  
You acknowledge and agree that PTA may at any time, in its absolute discretion, revoke, limit or prevent your access to the Service.

The Service is a wireless data service using radio frequency to provide access to the internet. You need a compatible device to access the Service.  

The PTA does not guarantee nor make any representation about the reliability of the Service. The Service may be interrupted from time to time due to system performance measurements or other configuration changes.  The PTA does not guarantee that the Service will be available at all times, or at all locations, nor that the performance of the Service will be suitable to provide internet access. 

We only allow access to HTTP, HTTPS and email traffic and access to many websites may be blocked by our filters including, content that contains adult or sexually explicit material, criminal activity, games, hacking, gambling, illegal drugs, peer to peer, phishing and fraud.

It is your responsibility as a user of the Service to determine the validity, quality and relevance of the information you obtain from the internet.

 

Security

The Service is provided on an open and public basis and you acknowledge and agree that there are inherent security risks associated with using the Service and that you do so solely at your own risk.
We do not guarantee that any information, software or other material accessible via the Service is safe, secure or free of viruses, worms, Trojan horses or other harmful components. 
PTA is not liable for, damage caused by viruses and malware that may infect device through your use of the Service. 
Due care is taken to ensure the privacy and integrity of the information you provide however, the possibility exists that this information could be unlawfully observed by a third party while in transit over the internet or while stored on our systems. We reject all liability to you to the greatest extent possible under law should this occur.
We are not responsible for the content of any website accessed or used via the Service. Your access to and use of any website or network connection whilst using the Service is entirely at your own risk.
   

Licence granted to you

We grant you a revokable, non-exclusive and non-transferable licence to use the Service in accordance with these Terms and may terminate this license at any time if you are in breach of the Terms.

 

Your Responsibilities

 You acknowledge and agree that when using the Service you will:

  • comply with all applicable laws;
  • not use the Service for commercial purposes;
  • not infringe the intellectual property rights of us and any third party in connection with the use of the Service.
  • You must not use the Service for File Transfer Protocol (FTP), Virtual Private Network (VPN) and Peer to Peer traffic or to make high volume data transfers, host a web server or any other server, collect other people's personal data without their knowledge or access someone else’s account, interfere with other network users for any defamatory or illegal purpose or disturb of cause offence to others.
  • Behave in a way which does not disturb or cause offence to your fellow passengers.
  • Be responsible for your own use of the Service and, for monitoring the use of the Service by any minors in your care, whether accompanied or unaccompanied as we cannot guarantee that our filters will successfully filter all offensive or illegal content. 

 

Our Liability

You use the Service at your own risk, and we do not accept any liability for any loss or damage caused by the Service, including any loss of computer programme data or information. 
We do not provide any guarantees in relation to the quality, stability, performance, fitness for purpose, security or availability of the Service.  
To the extent allowed by law, we exclude all liability to you and third parties in relation to your acts or omissions arising from or in connection with your use of the Service or your inability to use the Service.

 

Privacy

You acknowledge and agree that you consent to the PTA collecting, using, disclosing and processing information, some of which may contain your personal information.
When you access the Service, your device ID is recorded by the system to track your usage. This information is used to identify your device only.
When you use the Internet via the Service, all your Internet traffic and e-mail passes through our servers. The transmissions from your device via the Service will be filtered as set out above in 2 above (The Service).  However, we do not monitor, read or examine that traffic at any time in such a way as to view any personal data unless we are required to do so by law.
We reserve the right to collect, collate and use any data or user information which results from use of the Service for internal use only by the Public Transport Authority.
